WHAT DOES THE SETTLEMENT PROVIDE?
S has agreed to provide the following benefits to Settlement Class Members under the Settlement, which are two-part:
- Claims Made Benefit: All Settlement Class Members who file Valid Claims for Out-of-Pocket Losses may receive reimbursement up to $1,000 (per individual).
- Common Fund Benefit: Separately, Settlement Class Members may submit a claim for time spent dealing with the Data Incident, at $15/hour.
YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT | |
| Submit A Claim Form | This is the only way you may receive benefits from this Settlement. The Claims Deadline is May 1, 2023. |
| Exclude Yourself From The Settlement | You will receive no payment, but you will retain any rights you currently have with respect to Defendant and the issues in this case. The Opt-Out Deadline is April 1, 2021. |
| Object to the Settlement | Write to the Claims Administrator explaining why you do not agree with the Settlement. The Objection Deadline is April 1, 2022. |
| Attend the Final Approval Hearing | You or your attorney may attend and speak about your objection at the Final Approval Hearing. The Final Approval Hearing will be held on May 13, 2022. |
| Do Nothing | You will not get any benefits from the Settlement and you will give up certain legal rights. You will remain in the Settlement Class and be subject to the Released Claims. |
- Within 45 days of the Preliminary Approval Order, Defendants (i) will remove all pamphlets embedded in any webpage on Defendants’ websites accessible in the United States and (ii) will not possess PII of Settlement Class Members.
- Defendants shall not resume operation of the pamphlet on any webpage of their websites accessible in the United States that includes video content.
- Notwithstanding the above, Defendants may seek relief from this injunction upon amendment or repeal of the VPPA or upon implementation of a VPPA-compliant consumer consent form.
- Plaintiff may seek from the Court an injunction to enforce the terms of the Settlement Agreement.
- The settlement does not include any monetary compensation to Settlement Class Members.
